The AAFD Welcomes the Independent Association of BurgerIM® Franchisees
In the wake of bombshell revelations (reported on January 20th in Restaurant Business Online, “The BurgerIM Disaster”) of hundreds of franchisees not receiving promised services and support, and serious allegations of fraud, mismanagement, and misappropriation of franchisee funds, scores of BurgerIM franchisees have launched the BurgerIM Franchisees Chapter of the AAFD. The association has quickly established a steering committee, a membership committee, and a bylaws committee. It is preparing to elect a board of directors and is rapidly increasing its membership.
Save the date for the 2020 AAFD Franchisee Leadership Summit and Annual Conference: “Empowering Franchisee Associations”.
Last year’s AAFD Franchisee Leadership Summit and Annual Conference was a rousing success. We achieved a lot in 2019, but the fight for fair franchising is far from over! We need to keep the momentum going to further empower franchisees and protect the equity they work so hard to build in their franchise businesses. Join us this October in Mesa, Arizona for the AAFD’s 2020 Franchisee Leadership Summit and Annual Conference.

From the Archives: Are ‘Zors from Mars and ‘Zees from Venus?
I have compiled a list of the oft-made mistakes that both franchisors and potential franchisees make during the all-critical validation and expectations-setting process. Although no one can completely error-proof their decision, many of these mistakes can be easily mitigated a priori. And, if not, it can be the beginning of an unhappy, short-lived and financially underwhelming nuptial period.
New Franchise Loan Transparency Bill Introduced in the US Senate
As our friend, Keith Miller, principle of Franchise Advocacy Consulting, likes to say, there are far more franchisees in this country than franchisors. When we join our voices together, we can be a powerful and persuasive political force. It’s time to raise your voice to support an exciting new bill that was just introduced on July 31, 2019 in the United States Senate by Senator Catherine Cortez Masto (D-NV). While the bill’s overall aims are modest, the changes—if enacted—will require franchisors to provide more transparency to prospective franchisees or face financial consequences.
Keith Miller Testifies to Senate Subcommittee on Behalf of Franchisees

Why Your Franchisor May Not Provide the Supplier Benefits You Expect
Many potential franchisees become trusting of their chosen franchisor and go further to make the mistake of believing that their agreement and supply chain is, and must be, a “take-it-or-leave-it” ... Read More →
NYT Article Highlights Subway Franchisor Abuse
The New York Times recently released a scathing article that shines the light on systematic franchisor abuse at the world’s largest fast-food company, Subway.
How to Protect Your Franchisee Equity
The theme of the 2019 AAFD Franchisee Leadership Summit is “Protecting Your Franchise Equity,” but we very well might have called it “Reclaiming Your Equity.” Truly, the important benefits of business ownership expected by franchise owners have been under siege for decades, and franchisees continue to see serious erosion of their ability to increase and secure the value of their franchise investments.
Alabama Fair Franchise Legislation Stalls
What looked like the surprise franchise legislative effort for the year quickly stalled and is now on hold until next year. State Senator Chris Elliott introduced Senate Bill 129, the Protect Alabama Small Business Act, to specifically create protections for franchise owners in the state.
Independent Franchisee Associations—Special Limited Time Offer: FREE One-Year AAFD Association Membership Just for Checking Us Out!
For over 25 years, the AAFD has pursued a market driven approach to reforming the franchise community. Unfortunately, we live in a political climate dominated by franchisor influence and a dearth of franchisee associations rallying together in common cause. The laws and legal precedents continue to strongly favor franchisor interests. The importance of franchisee associations to aggregate their combined resources under a common banner has never been more essential.
New Supreme Court Decision Could Make It More Difficult for Franchisors to Negotiate with Franchisees During Chapter 11 Bankruptcy
Franchisors have used Chapter 11 bankruptcy to both restructure their debts and to demand concessions from franchisees. A new Supreme Court decision could take away, or at least blunt, this practice. ... Read More →
Washington Voids Most Non-Compete Agreements
Last week, Jay Inslee, the Washington state governor, signed House Bill 1450 which voids most non-compete agreements in Washington state. The law also prohibits francihisors from enforcing non-solicitation clauses. Here is a quick summary of what the law does and does not do, how it may be challenged in the courts, and how it will affect franchisees operating in Washington state or with Washington state based employees.
